General Terms and Conditions of Locster Tattoo
§1 Applicability to entrepreneurs and definitions
(1) The following General Terms and Conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity (Section 13 of the German Civil Code).
§2 Formation of a contract, storage of the contract text

(3) The presentation of goods in our online shop does not constitute a legally binding offer on our part, but is merely a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase agreement.
(4) The following provisions apply upon receipt of an order in our online shop: The consumer submits a binding offer by successfully completing the ordering process provided in our online shop.
The order is placed in the following steps:

5) Log in to the online shop after registering and entering your login details (email address and password).

Before submitting the order, the consumer can review their information and correct any errors by clicking the "Back" button in their web browser. Alternatively, they can cancel the order process by closing the browser. We will immediately confirm receipt of the order with an automatically generated email ("Order Confirmation"). This email constitutes our acceptance of your offer.
(5) Storage of the contract text for orders placed through our online shop: We will send you the order details and our Terms and Conditions via email. You can also view the Terms and Conditions at any time at https://millionthoughts-merchandise.myshopify.com. For security reasons, your order details are no longer accessible online.
§3 Prices, shipping costs, payment, due date
(1) The prices quoted include statutory VAT and other price components. Shipping costs are additional.
(2) The consumer has the option of paying in advance or via PayPal.
(3) If the consumer has chosen to pay in advance, they are obligated to pay the purchase price immediately after conclusion of the contract.
§4 Delivery
(1) Unless we have clearly stated otherwise in the product description, all items offered by us are ready for immediate shipment. Delivery will take place within 7 working days at the latest. The delivery period begins, in the case of payment in advance, on the day after the payment order is issued to the bank responsible for the transfer, and in the case of all other payment methods, on the day after the contract is concluded. If the last day of the delivery period falls on a Saturday, Sunday, or public holiday at the place of delivery, the period ends on the next working day.
(2) Even in the case of mail order purchases, the risk of accidental loss or accidental damage to the goods sold passes to the buyer only upon delivery of the goods to the buyer.
§5 Retention of Title
We retain ownership of the goods until the purchase price has been paid in full.

The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
Exceptions to the right of withdrawal
There is no right of withdrawal for contracts for the supply of goods that are not prefabricated and for whose production an individual selection or specification by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

You must inform us of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax or email). You may use the attached model withdrawal form, but this is not obligatory.
Consequences of withdrawal: If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods.
